If Arrested

IF ARRESTED

If you have been charged in a criminal matter, keep in mind that the less you say about it to anyone, the better off your defense will be. You have Miranda rights and you should not be intimidated by police officers, or anyone else, into giving them up. Whether you are an adult citizen or non-citizen, you have certain rights if you are arrested. Before a law enforcement officer questions you, he or she should give you your Miranda Warnings.:

Miranda Warnings:

  • You have the right to remain silent.
  • Anything you say can and will be used against you.
  • You have the right to have an attorney present while you are questioned.
  • If you cannot afford an attorney, one will be appointed for you.

Just say that you want to speak with your attorney before you answer any other questions. Then, call an attorney and see him as soon as possible. Once you are booked into custody you have a right to make and complete three phone calls that are free within the local calling area.

The fact is, having an experienced criminal defense attorney on your side from early stages can often make a big difference in the ultimate outcome of your case.

As a criminal lawyer I can tell you that violating the laws in California can bring very severe penalties. There is nothing more important than having the right criminal defense lawyer. As an experienced defense attorney, I may be able to get your charges reduced and in some cases dismissed. If jail time is inevitable, I may be able to get this jail time reduced or find a suitable alternative to jail such as house arrest, swap, work release, drug rehabilitation or work furlough modernpropertysolutions.com/.

When you retain me as your defense attorney you will receive my personal attention. I will personally handle every part of your case. I prepare each case carefully to find any legal defenses and to see whether your constitutional rights were violated. Was evidence seized? Was an arrest made that violated your 4th amendment rights against unreasonable search and seizure? Did the police explain your right to be silent before you were questioned? Was there a proper chain of custody for the evidence seized?

As an aggressive and experienced attorney, I can provide expert witnesses to challenge a prosecutor’s case, file Motions to Suppress, contest illegal searches and seizures, file Motions to Strike prior convictions, negotiate alternatives to jail and obtain reduced sentence modifications.

Fighting a criminal case can be very complicated. Did you know that many cases are dismissed on technicalities? An attorney must have knowledge of the court system and know the different personalities of Judges and Deputy District Attorneys.

I know that being accused of a criminal offense is very distressing and unsettling. You may have some questions as to what direction to take. Please contact my office 805.966.6806.
