Infraction – A crime that is not punishable by imprisonment.  A person charged with an infraction is not entitled to a trial by jury and not entitled to have a public defender or other counsel appointed to defend him or her unless he/she is not released on his/her written promise to appear, own recognizance, or deposit of bail.

 

Misdemeanor – A crime that is punishable by up to six months in jail or by fine not exceeding $1,000 or by both except when the state prescribes a greater punishment.

 

Felony A crime that is punishable by imprisonment in the State Prison.
